Who provides the service
Comunaris is a service provided by María Claudia Vásquez Arias Schreiber, an individual trading as a sole proprietor, with Spanish foreign national ID (NIE) Y7568049M and address at Calle Alonso de Ojeda 17, 6.º C, 30007 Murcia (España). Contact: hola@comunaris.com.
These terms govern the use of Comunaris and the purchase of its subscriptions. By creating an account or buying a subscription, you accept them.
Who processes payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles payment, issues the invoices, takes care of any applicable sales tax and answers customer service enquiries about payments and returns.
When you pay, you also accept Paddle's checkout buyer terms (paddle.com/legal/checkout-buyer-terms), which govern the purchase itself.
The service
Comunaris is a web application for managing buildings, condominiums and owners' associations: the register of properties and owners, dues and receipts, meter readings, bookings of shared spaces, vendors, announcements and a change history. It is provided as available at any given time and its features may be improved or changed.
Your account
- You need an account to use the application, with your email address and a password or with your Google account.
- You are responsible for keeping your credentials secret and for whatever is done from your account.
- The data you enter must be accurate, and you must be authorised to process any third-party data you include, such as that of owners and contacts.
Subscription and trial building
- You can create a free trial building without giving any payment details. It holds a limited amount of data and does not expire.
- To use a building without limits you buy a subscription for that building, monthly or yearly. Once it is active, the trial building becomes a paid building and keeps all its data.
- The subscription price is the one shown when you buy it, plus any taxes that apply in your country, which Paddle calculates and itemises at checkout.
- The subscription is charged in advance at the start of each period.
Renewal and cancellation
- The subscription renews automatically at the end of each period, for another period of the same length, unless you cancel it first.
- You can cancel at any time by writing to hola@comunaris.com or from the management link Paddle includes in your receipts. Cancellation takes effect at the end of the period already paid for: until then the building keeps working as normal.
- If a payment fails, the building keeps working as normal for 30 days while it is retried; if it is not resolved, the building becomes read-only.
- Refunds are governed by the Refund policy.
Price changes
We may change subscription prices. We will tell you by email at least 30 days in advance, and the new price will apply from your next renewal. If you do not agree, you can cancel the subscription before then.
Acceptable use
You agree not to use Comunaris to:
- carry out unlawful activities, or process personal data without a legal basis;
- try to access data of buildings you do not manage, or get around the security measures;
- overload, damage or interfere with the running of the service;
- resell or hand the service over to third parties without authorisation.
We may suspend an account that breaks these rules, telling you first whenever possible.
Liability
We take reasonable steps to keep the service running continuously and securely, but we do not guarantee that it will be free of errors or interruptions. To the extent permitted by law, our total liability to you for any claim is limited to what you paid for the service in the previous 12 months, and we are not liable for indirect damage or loss of profits. Nothing in this section limits the rights consumer protection law gives you.
Personal data
We process personal data as described in the Privacy policy. For the data of the buildings you manage, we act as a processor on behalf of whoever manages the account.
Read the privacy policyGoverning law
These terms are governed by Spanish law. For any dispute, the parties submit to the courts that have jurisdiction under the law; if you are acting as a consumer, to those of your place of residence. This does not deprive you of the protection given by the mandatory rules of your country of residence.
Changes to these terms
If we change these terms, we will publish the new version on this page with its update date and, if the change is significant, we will tell you by email before it takes effect.
